These Terms of Use (“Terms”) govern your use of BossLead.my (the “Service”), operated by BossLead.my (“we”, “us”, “our”). By creating an account, buying a plan or using the Service, you agree to these Terms. If you use the Service for a company, you confirm you are authorised to accept these Terms on its behalf, and “you” includes that company.
1. The Service
The Service helps businesses find other businesses to sell to. It lets you search company information, reveal contact details, save prospects, and contact them by email and WhatsApp, including with messages written with the help of artificial intelligence (“AI”). Some features depend on your plan.
The Service is for business use only. You must be at least 18 years old to create an account.
2. Your account
Give accurate details when you register and keep them up to date. You are responsible for everything done under your account and for keeping your password safe. Tell us straight away at kai-sheng@hotmail.com if you think someone else has used it.
An account is for one person. Do not share logins; add team members through the team features of your plan instead. To protect accounts, signing in on a new device may sign out other devices.
3. Free access and usage limits
Visitors and free accounts may search and reveal a limited number of contacts. Paid plans include monthly allowances (for example reveals, emails and WhatsApp messages) shown on the pricing page and in your account. Unused allowances do not carry over unless your plan says so.
We may set and change fair-use limits to keep the Service working for everyone and to prevent misuse, such as revealing or exporting large volumes of data in a short time.
4. Plans, billing and cancellation
Paid plans are subscriptions billed in advance, monthly or yearly, through our payment provider Stripe. Subscriptions renew automatically until cancelled. Prices are shown before you pay and may include or exclude taxes as stated there.
Upgrades take effect immediately and are charged pro rata. Downgrades and cancellations take effect at the end of the current billing period; you keep access until then. If a payment fails, paid features may be paused until it is paid.
We may change our prices. We will tell you in advance, and the new price applies from your next renewal. If you do not agree, cancel before the renewal date.
5. Refunds
Fees already paid are not refundable, including for partly used periods and unused allowances, except where the law requires a refund or where we decide, at our discretion, to give one. Free trials can be cancelled before they end at no charge.
6. Company information
Company and contact information in the Service is compiled from public sources, data partners and businesses that list themselves. We work to keep it accurate, but we do not guarantee that it is complete, current or correct. Check important details before relying on them.
You may use revealed information only for your own business development. You may not resell, publish, share with third parties, or build a competing database from it, and you may not copy, scrape or bulk-download the Service by automated means.
7. Your messages and the law
You are the sender of every email and WhatsApp message you send through the Service, and you are responsible for it. You must comply with all laws that apply to you and to the people you contact, including the Personal Data Protection Act 2010 of Malaysia and similar data protection and anti-spam laws in other countries.
In particular you agree to: contact only people you are lawfully allowed to contact; identify yourself and your business truthfully; not send false, misleading or offensive content; and honour every opt-out (such as “unsubscribe” or “STOP”) straight away. The Service stops messages to people who opt out; do not contact them again by other means to get around this.
We may pause or stop campaigns, limit sending, or suspend accounts if we see complaints, high bounce or block rates, or other signs of unwanted messaging.
8. WhatsApp
WhatsApp is a service of WhatsApp LLC (Meta). When you use WhatsApp through the Service you must also follow WhatsApp’s terms, including the WhatsApp Business Messaging Policy. Meta decides on quality ratings, messaging limits and template approvals; we do not control them.
Linked phone. If you link your own WhatsApp number by scanning a QR code, messages are sent from your phone through an unofficial connection, not Meta’s official Business API. WhatsApp may restrict or permanently ban numbers that send automated, bulk or unsolicited messages. You choose to use this feature at your own risk. We recommend using a number you can afford to lose and keeping sending limits low.
Sending limits. The Service spaces WhatsApp messages out and limits how many are sent a day. You may raise these limits; higher limits increase the risk of your number being restricted or banned. We are not responsible for any restriction, ban, loss of chats or contacts, or loss of business that results from your use of WhatsApp, including at limits you chose.
9. AI-generated content
Messages, summaries and suggestions written with AI may be inaccurate or unsuitable. Read and edit them before sending. You are responsible for any message you send, whether you or the AI wrote it. Do not enter information into AI features that you are not allowed to share.
10. Acceptable use
You must not:
- use the Service for anything unlawful, fraudulent or harmful, or to harass anyone;
- send spam, phishing, malware, or messages about illegal, adult or deceptive products and schemes;
- impersonate anyone or hide who you are;
- try to break, overload, probe or get around the security, limits or billing of the Service;
- reverse engineer the Service, or access it by automated means except through features we provide;
- upload content you have no right to use.
11. Your data and privacy
You keep ownership of the content and data you add to the Service (such as your lists, messages and company profile). You give us permission to store and process it only to provide and improve the Service. How we handle personal data is explained in our Privacy Policy.
Where you use the Service to process personal data of the people you contact, you are responsible for having a lawful basis to do so and for answering their requests about their data.
12. Third-party services
The Service connects to services run by others, such as Stripe for payments, Meta for WhatsApp, Google and Microsoft for email mailboxes, and AI providers. Your use of those services is also governed by their own terms. We are not responsible for them, for their availability or for changes they make.
13. Our rights
The Service, its software, design and content (other than your content) belong to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing.
14. Suspension and termination
You can stop using the Service and cancel your plan at any time from your account. We may suspend or close your account, without refund, if you break these Terms, misuse the Service, fail to pay, or if we must do so by law. Where reasonable we will tell you first and give you a chance to fix the problem.
15. Disclaimer
The Service is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or that it will bring you any particular result, such as replies, leads or sales.
16. Limitation of liability
To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data, goodwill or business, or for the suspension or ban of any email or WhatsApp account. Our total liability to you for all claims in any 12 months is limited to the fees you paid us in those 12 months. Nothing in these Terms limits liability that cannot be limited by law.
17. Indemnity
You will compensate us for claims, fines and costs (including reasonable legal fees) caused by your messages, your content, or your breach of these Terms or of the law.
18. Changes to these Terms
We may update these Terms. We will show the new date at the top and, for important changes, tell you by email or in the Service. If you keep using the Service after a change takes effect, you accept the updated Terms.
19. Governing law
These Terms are governed by the laws of Malaysia. The courts of Malaysia have jurisdiction over any dispute, unless the law of your country gives you the right to bring a claim where you live.
